1. Creator Service Overview

The Service provides a platform where you can access and purchase merchandise, digital products, music, and memberships (“Memberships” and, collectively with all other offerings, "Products").

Additionally, Creator may make certain content, including music, available for non-commercial use with proper attribution, as detailed below.

2. Eligibility

You must be at least 13 years old to use the Service. By agreeing to these Terms, you represent and warrant that:
(a) You are at least 13 years old;
(b) You have not previously been suspended or removed from the Service; and
(c) Your use of the Service complies with all applicable laws and regulations.

If you are an entity or organization, the individual accepting these Terms on your behalf represents and warrants they have the authority to bind you to these Terms.

3. Accounts and Registration

To access certain content, make purchases, or use Memberships, you may need to register for an account. You agree to:

• Provide accurate and up-to-date information (e.g., name, email address).
• Maintain the confidentiality of your account credentials.

You are responsible for all activities under your account.

4. Use of Content (Including Music)

Non-Commercial Use

• Creator allows the use of certain content, including music, for non-commercial purposes under the following conditions:
  1. Attribution: You must credit MrBAS Music Labs as the original creator. The credit must include:
     • Name of the music or content.
     • Link to the official website (https://mrbasinsmusic.club), channel, or service where the content was originally published.
  2. Notification: You must notify the Creator of your intent to use the content via email at mrbasins@gmail.com, including details about the intended use.
  3. Usage Restrictions: Content must not be used for illegal, offensive, or defamatory purposes.

Commercial Use

• Permission Required: Commercial use of any content, including music, is strictly prohibited without the Creator’s prior written permission.
• Royalties and Compensation: Any commercial use of the Creator’s content will require a licensing agreement and may involve royalty payments to the Creator. The specific royalty percentage will be determined on a case-by-case basis.

Comments or Edits to Content

• Permission Required: You must obtain the Creator’s permission before making any changes, edits, or derivatives of the content.

5. General Payment Terms

Purchasing Products or Memberships may require you to pay fees displayed before purchase. Fees will be charged in U.S. Dollars (USD) or Canadian Dollars (CAD) based on your location. All taxes, including GST, PST, and other applicable charges, will be calculated at checkout.

6. Attribution and Linking

When using the Creator’s content, including music:

• You must include a visible attribution in the format:
  “[Content Title] by MrBAS Music Labs. Used with permission. Visit https://mrbasinsmusic.club for more.”
• You must link back to the Creator’s official website, channel, or services where the content was originally published.

Failure to include proper attribution may result in the termination of your usage rights.

7. Violations and Enforcement

If you violate these Terms regarding the use of content:

• Creator reserves the right to revoke permissions for any future use.
• Creator may take legal action to recover any unpaid royalties or damages resulting from unauthorized use.

8. Returns and Refunds

We accept returns or issue refunds only for defective Products.

• Defective Products: Returns must be initiated within 30 days of purchase. Clear photos of the defective item on a flat, well-lit surface must be submitted.
• Non-defective Products are not eligible for return or refund.

9. Taxes (Canada and U.S.)

For Canadian orders:

• GST (Goods and Services Tax): 5% applies across Canada.
• PST (Provincial Sales Tax): Rates vary by province.
• HST (Harmonized Sales Tax): Applies in certain provinces (e.g., 15% in Nova Scotia).

For U.S. orders:

• Applicable state sales tax will be calculated and applied at checkout, based on your shipping address.

10. Governing Law

For users in the U.S., these Terms are governed by the laws of the State of California, and disputes will be resolved in San Francisco County.
For users in Canada, these Terms are governed by the laws of the Province of Ontario, and disputes will be resolved in Ontario courts.
